We are legal counsel to Hyper Ice, Inc. and Hyperice IP Subco, LLC (“Plaintiff” or “Hyperice”).  This letter serves as notice that a lawsuit has been filed by Hyperice against you (“Defendant”) in the United States District Court for the Southern District of New York, Case No. 25-cv-3643 (VSB) (“Lawsuit”). On May 22, 2025, the Court entered an ex parte Temporary Restraining Order, Order Restraining Defendant’s User Accounts, Merchant Storefronts and Defendants’ Assets with the Financial Institutions, Order to Show Cause Why a Preliminary Injunction Should Not Issue, Order Authorizing Bifurcated and Alternative Service and Order Authorizing Expedited Discovery against Defendant (“Order”). On May 30 17, 2025, the Court entered an Order extending the TRO and adjourning the date of the Show Cause Hearing (“May 30, 2025 Order”) (the TRO and May 30, 2025 Order are collectively, hereinafter referred to as the “Orders”).

Pursuant to the Orders, Defendant is ordered to appear before Judge Vernon S. Broderick via teleconference hearing on June 30, 2025 at 11 a.m. EST and show cause why a preliminary injunction should not issue against Defendant (“Show Cause Hearing”). Please be advised that Defendant’s failure to appear at the Show Cause Hearing may result in the imposition of a preliminary injunction against you, which may extend throughout the length of the Lawsuit.
